This is an English translation of the German Terms of Service for informational purposes. In case of doubt, the German version (/terms) prevails for users residing in Germany.
These Terms of Service govern the use of the mobile application "Pin Your Plate" (the "App") and the website pinyourplate.app. The operator and contracting party is:

By installing and using the App you accept these Terms. Deviating terms of the user shall not apply.
Pin Your Plate enables users to save culinary locations ("pins") on a map, add photos, notes and ratings, organize gatherings ("meetups") and share content with other users.
The App is generally offered free of charge. Optionally, one-time digital add-ons ("Founder Pack" or "Premium Pack") can be purchased (see section 9).
Use of the App is permitted for persons aged 16 and over. Persons under 16 require verifiable consent of their legal guardians (Art. 8 GDPR). The App is not directed at children.
You retain all rights to the content you upload (pins, photos, notes, meetups). You warrant that you hold the necessary rights and do not infringe third-party rights.
By uploading content, you grant the Provider a non-exclusive, worldwide, royalty-free, revocable and transferable license to store, reproduce, display and – in accordance with your visibility settings – make your content accessible to other users, solely for the purpose of operating, providing and further developing the App. No further use (e.g., marketing, resale, advertising outside the App) will take place.
The license terminates automatically upon deletion of the content or account, except for:

Any user may report content or profiles within the App via the "Report" function. Reports should contain a reason and, where possible, a description. Reports may also be submitted by e-mail to support@pinyourplate.app.
We review reported content promptly. For manifestly illegal content, we take action within 24 hours where reasonable. For all other cases, review takes place as promptly as possible, usually within 7 days.
Depending on the severity of the breach, we may in particular take the following measures:
Affected users will be informed of measures taken, unless notification is excluded in an individual case (e.g., for illegal content where notification could impede law enforcement). Against moderation decisions, users may lodge a complaint by e-mail to support@pinyourplate.app within 6 months (Art. 20 DSA). A renewed, independent review is carried out within 14 days.
Users have the right to choose a certified out-of-court dispute settlement body under Art. 21 DSA to resolve moderation disputes.
You may block other users at any time. Blocked users will no longer see your profile, pins or meetups and cannot interact with you.
The contract for digital content (§ 327 German Civil Code) is concluded upon confirmation of the purchase via the respective platform (Apple App Store or Google Play). Billing is exclusively via your store account; payment processing is subject to the terms of Apple / Google.
All prices are stated in the currency displayed for your store account and include statutory VAT where applicable.
The "Founder Pack" and "Premium Pack" unlock non-subscription digital add-ons (e.g., exclusive color themes, 3D map style). A user can only ever purchase one of the two.
Right of withdrawal
Consumers have a right of withdrawal in accordance with the following provisions. A consumer is any natural person who enters into a legal transaction for purposes predominantly outside their trade, business or profession.
You have the right to withdraw from the purchase contract for digital content within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract.
To exercise your right of withdrawal, you must inform us (Marius Wenk, Arcostraße 48, 15831 Mahlow, Germany, e-mail: support@pinyourplate.app) of your decision to withdraw from the contract by a clear statement (e.g., by e-mail).
Early expiration of the right of withdrawal: pursuant to § 356(5) German Civil Code, the right of withdrawal expires once we have begun to perform the contract for the supply of digital content not on a tangible medium, provided that you (1) have expressly consented to the performance commencing before the end of the withdrawal period, and (2) have acknowledged that by giving your consent you lose your right of withdrawal. By purchasing via the App Store or Google Play and the immediate unlocking of the content, you provide this consent.
Consequences of withdrawal: in case of effective withdrawal, the services received on both sides must be returned. Refunds are processed via the respective store platform (Apple/Google) in accordance with their refund policies.
For refunds in general, the policies of the respective store platform apply:
Statutory warranty rights apply. For digital products purchased for a fee, §§ 327 et seq. German Civil Code apply. Where the App is provided free of charge, the rules on gifts and gratuitous contracts apply with corresponding limitations.
We are liable without limitation for intent and gross negligence, for damages resulting from injury to life, body or health, and under the German Product Liability Act.
For ordinary negligence, we are only liable in the event of a breach of essential contractual duties ("cardinal duties"), the fulfilment of which is essential for the proper performance of the contract and on which the user may regularly rely. In such cases, liability is limited to the foreseeable damage typical for the contract.
Any further liability is excluded. These limitations do not apply where stricter liability is mandatorily prescribed by law.
We assume no warranty for the correctness, completeness or timeliness of user-generated content (e.g., ratings, opening hours, pin details).
We strive for high availability of the App but do not owe any specific availability. Maintenance, updates, network outages or force majeure may lead to temporary restrictions.
The contract is concluded for an indefinite period and can be terminated at any time by either party without giving reasons:
Upon account deletion, personal data is deleted as described in section 8 of the Privacy Policy.
We reserve the right to amend these Terms where required for legal reasons, due to changes in case law, new features or to maintain a balanced contractual relationship. We will inform you of material changes at least 6 weeks prior to their entry into force by e-mail or in-app notice. If you do not object to the change within this period, this shall be deemed consent. We will expressly point out the right to object and its consequences. In the event of an objection, both parties retain the right to ordinary termination.
The European Commission provides an online dispute resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
We are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration body (§ 36 VSBG).
